The Chain of Responsibility provisions of the Heavy Vehicle National Law imposes obligations on consignors and consignees who have influence over how and when freight is delivered. These obligations are not well understood by many freight chain participants.

This session will consider an overview of recent court cases involving CoR and their ramifications on industry.

SESSION 8: TECHNOLOGY AS A DRIVER OF CoR COMPLIANCE

ALC has long argued that it should be mandatory for heavy vehicles to collect and maintain data relating to speed and fatigue offences so it is available for use by both businesses and enforcement agencies.ALC believes legislation requiring the capture of data for statutory reporting and monitoring purposes should rely on an open standards and a systems platform approach rather than prescribing particular pieces of hardware and without the overriding concern to ensure the collection of data to ‘evidentiary standards’ in aid of (in particular) prosecutions where proof beyond reasonable doubt must be presented to support a prosecution.
